Bellevue Council voted unanimously to override Mayor George Doscher’s veto of the salary ordinance adopted by council in December.

Doscher said that he disagreed with a provision of the ordinance that required non-contract employees to contribute 10 percent of the cost of their health insurance. A recent contract reached with the firefighters union set their contribution rate at only 5 percent. Members of the police and public works unions currently contribute nothing.

For the second time in as many weeks, an attempt to oust Bellevue’s solicitor has failed.

A week after a motion to seek proposals from attorneys failed in a tie vote at the borough council’s reorganization meeting, a second motion made at the first regular council meeting on Tuesday met the same end.

The post-election reorganization of Bellevue Council Monday night was not without incident -- several of them in fact. The meeting began with one council member-elect omitted from the swearing-in, and ended with questions about the legitimacy of the entire process. In between, a new regime took charge of council, and perhaps set the tone for the coming year.

Barely a month after voters rejected allowing liquor licenses in Bellevue, the borough is dealing with a proposal to sell beer in Bayne Park -- a proposal from the borough's own employees.

The idea for a "beer corral" in the park developed from plans to hold an arts festival to raise money for the borough's matching share of a grant to build a skate plaza in Bayne Park.

Bellevue Council voted Tuesday to include director of administrative services Doug Sample in a cafeteria benefits plan that could net the new DAS another $3,600 per year.

As part of the cafeteria plan, employees can choose not to be covered by the borough’s health insurance, and instead be compensated $300 per month. Some members of council said that Sample had agreed, as part of his employment contract with the borough last summer, not to take part in the benefits plan, and that his starting salary was increased because of that.

Bellevue's new director of administrative services could end up getting a nice pay raise in the coming year, regardless of an employment contract that some officials think should preclude it.

Although new DAS Doug Sample agreed to waive health insurance benefits when he was hired last summer, he still may be able to take advantage of a $300 per month opt-out payment the borough offers employees.

Bellevue Borough will install new guiderails in a turn-around area on East Roseridge Avenue while officials try to figure out what it will take to maintain the property legally.

Solicitor Tom McDermott told council members at their meeting on Tuesday that although the borough reportedly has maintained the property in the past, it is not clear that the area actually belongs to the borough or falls within the borough’s right of way. There also is the issue of decades worth of accumulated fill dumped in the area in a “non-engineered way,” McDermott said, that could create a liability.

Bellevue Council, at its work session held Tuesday, voted to approve the settlement of a lawsuit stemming from residential damage caused by a sewer line break.

Solicitor Tom McDermott said that in addition to the $15,000 that will be paid by the borough’s insurance company, Bellevue also will have to pay $6,000.

The settlement was approved in a unanimous vote with council president Kathy Coder absent.

For the second time in recent months, Bellevue Council did not have the votes necessary to approve paying the borough’s bills due to concerns about the hiring of a new solicitor last December. That solicitor, however, says that his hiring was completely legal and no further action is necessary.

With three council members and the mayor absent from the Sept. 28 meeting, a motion to pay the borough’s bills failed in a tie vote. Voting in favor were council members Kathy Coder, mark Helbling and David Gillingham Jr. Opposed were Jane Braunlich, Linda Woshner and Susan Viscusi.

With Bellevue Council member Mark Panichella absent, Mayor George Doscher had to break a tie vote to authorize the borough to pay its bills.

Four members of council -- Linda Woshner, Jane Braunlich, and Jim and Susan Viscusi -- have been voting against payment of the bills since January because the bill list includes payment to solicitor Tom McDermott.

A lame duck council appointed McDermott last December, something prior solicitor Michael Georgalas warned was illegal and could result in individual council members being assessed for any borough funds spent to pay the new solicitor.

Bellevue Council's public safety committee will take another shot at drafting an ordinance regulating recreational fires after officials and residents agreed there was no "burn" in the burn ordinance proposed.

The committee reviewed the issue after receiving complaints from residents about outdoor fires that had become a nuisance due to the quality and quantity of smoke being produced.

Should transient vendors pay a fee to do business in Bellevue? As another season of farmers markets and other events kicks off, some borough officials and business owners think vendors should be charged.

Bellevue has an ordinance covering transient vendors such as those who set up shop at the weekly farmers markets and other events organized by Enjoy Bellevue, including a car cruise in May and the Summer Solstice in June. That ordinance requires vendors to obtain a permit when they sell items in Bellevue, with a fee charged for each permit.

Bellevue's new solicitor is finding out the hard way what it means to earn his retainer in the borough.

Tom McDermott found himself uninformed and on the hot seat as Bellevue Council wrangled over several issues at its twice-rescheduled regular meeting on Feb. 16.

The issue was consistency versus flexibility as Bellevue Council debated a proposed amendment to the borough's administrative code that would allow them to change the regular meeting date from the first Tuesday of every month.

While the state law that governs other boroughs, as well as Bellevue's own home rule charter, requires only that council meet at least once per month, the administrative code in Bellevue mandates the regular meeting be held the first Tuesday of each month.
