Emsworth Council will revisit the borough's proposed street opening ordinance after receiving some cautionary advice from the solicitor.
Council was ready to adopt a new ordinance that would require contractors digging into a newly-paved street to replace not only the area excavated, but the pavement all the way across the street and for 50 feet in each direction from the street opening.
Solicitor Robert McTiernan said that although Pennsylvania law does not prohibit the borough from setting such requirements, case law from nearby states has struck down ordinances that require such substantial repair.
Council agreed to review the proposed ordinance. Council member Paul Getz said that the borough wanted to be reasonable, but also "let the utilities know we're serious about them tearing up our streets."
